Jurisdictional Conflicts Within the State: Autonomous Communities and other Sub-National Entities in Spain

Abstract

The Spanish Constitution was approved in 1978 and calls for the establishment of Autonomous Communities (Autonomous Regions). The Constitution also recognises the right to a certain degree of autonomy of Local Entities such as Municipalities and Provinces. This article reviews the different powers assigned the Central State, the Autonomous Communities and the Local Entities in the energy sector and demonstrates how potential conflicts among them may be resolved.
