Delimitation of Energy Law Jurisdiction: the EU and its Member States: From Organisational to Regulatory Conflicts

Abstract

With an increasing regulatory framework being introduced under European Community law, Member States may gradually lose their ability to organise their electricity and gas sectors. Different levels and types of jurisdictional conflicts in this context are examined. Despite the emergence of new Community directives and recent decisions by the European Court of Justice, there remain more questions than answers.
