Jurisdiction to Enforce Competition Law in Europe: an Analysis of the European and German Legal Regimes

Abstract

This article analyses the dichotomy of European and German competition (antitrust) law systems and the delimitation of their respective scopes of application, the pertinent administrative enforcement competences on the European and German levels, as well as the relationship between national (German) and the European Court of Justice (ECJ). Specific jurisdictional problems concerning Article 90(2) of the EC Treaty are also examined.
