Abstract
As national and international interest in the mining sector in Namibia increases, the question of access to land on, or under, which the mineral deposit may lie, as well as compensation payable to exercise a right in a mine, becomes ever more relevant. This legislation attempts to balance the rights of the landowner as against the holder of a mineral licence. In doing so, the legislation attempts to balance the rights of a landowner to be able to continue his/her activities on the land in question, with the right of the holder of a mineral licence who wishes to exercise his/her rights in terms of the licence.
