  • The problem is dealt with in Benjamin's Sale of Goods (2nd ed.) paras. 1828, et seq., although the treatment given there and in other works ignores the additional complication of the Factors Acts and s.24 and 25 of the Sale of Goods Act 1979: for example a conflict of claims might arise between a buyer from an unpaid fob seller in possession of the documents of title and a person who claims title through the original purchaser of the goods to which those documents relate.
