  • On the other hand, the same Land Government that is responsible for the licensing procedure for the SNR 300 has strongly promoted another international project carried out by the U.K., the Netherlands and West Germany, the URENCO uranium enrichment plant, which is in operation since March 1986. This nuclear installation has never become the subject of political disputes.
  • The delay in the construction of the fast breeder is, however, also due to a legal reason: there were doubts if the Atomic Energy Act was at all applicable to fast reactors. These doubts have only been eliminated by a decision by the German Federal Constitutional Court of August 8, 1978 (BVerfGE 49, pp. 89 et seq.). The Court held that the Atomic Energy Act could at least be applied to the prototype SNR 300 but that in case future scientific progress would prove the fast reactor to be particularly hazardous, the Constitution would require the legislator to re-examine whether the German atomic energy law was still a sufficient basis for granting nuclear licences for the fast breeder. The Court examined the case merely on the basis of the German Constitution and the national Atomic Energy Act and without taking international relations into consideration.

  • Some Länder are favourable to foreigners living abroad. They treat such foreigners and the citizens as equal (North Rhine-Westphalia and Baden-Württemberg). In Lower Saxony things are just the contrary: there the principle of absolute territoriality according to which such foreigners cannot be affected by German administrative decisions is supported. Bavaria is to be found in between: there foreigners may participate in the licensing procedure but they are not granted any rights.
